The protection of your personal data is of particular concern to us. In this Privacy Policy, we inform you about the processing of personal data in connection with the use of our website mtop.at and our program activities.
The processing of personal data is carried out exclusively in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

2. Data Processing on Our Website
2.1 General Website Use
Each time our website is accessed, technical data is automatically collected and stored in server log files. This includes the IP address, date and time of access, page accessed, referrer URL, as well as browser type and operating system. This data is used exclusively to ensure the technical operation of the website and is deleted after a maximum of 14 days.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in the secure operation of the website).
2.2 Contact Form
When you submit an enquiry via the contact form on our website, the data you provide (name, e-mail address, message) is stored for the purpose of processing your enquiry and any follow-up questions. We do not pass on this data without your consent.
Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures) and/or Art. 6(1)(f) GDPR (legitimate interest in processing your enquiry).
2.3 Website Platform (Wix)
Our website is operated via the platform Wix.com Ltd. (1 Nevinland Street, Tel Aviv 6777018, Israel). Wix processes technical data of website visitors as a data processor. Data transfers to third countries are carried out on the basis of standard contractual clauses of the European Commission. 2.4 Web Analytics
We use web analytics tools to understand the use of our website and to improve our offering. Information about your usage behaviour (pages visited, time spent, origin of visit, etc.) is collected. This data is processed in anonymised or pseudonymised form.
Wix Analytics: As an integral component of our website platform, Wix Analytics collects basic visitor statistics.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in optimising our offering). For non-essential cookies and tracking tools, we obtain your consent via our cookie banner (Art. 6(1)(a) GDPR).

Our website uses cookies. Cookies are small text files stored on your device. We distinguish between:
• Technically necessary cookies: These are required for the operation of the website and cannot be deactivated.
• Analytics cookies: These help us to understand how the website is used. They are only set with your consent.

3. Data Processing within Our Programs
3.1 Applicants for the MTOP Associate Program
As part of your application for the MTOP Associate Program, we process the following personal data:
• Master and contact data: name, address, date of birth, telephone number, e-mail
• Identification data: identity document details, residence permit
• Application documents: curriculum vitae, information on education and professional experience
• Information on professional and personal goals
Legal bases:
• Art. 6(1)(b) GDPR (pre-contractual measures / decision on program admission)
• Art. 6(1)(a) GDPR (consent actively given during the application process)
Data is retained for the duration of the application process and, if admitted to the program, for the entire duration of the program, as well as beyond this period insofar as statutory retention obligations exist.
3.2 MTOP Associates and Alumni
As part of the further training, support and placement activities, we process the following personal data of program participants:
• Master and contact data, identification data
• Information on professional and personal goals
• Image and sound data (e.g. photos and video recordings, provided you have given your consent)
• Information on program progress and learning outcomes

• Art. 6(1)(b) GDPR (fulfilment of the Associate-Agreement)
• Art. 6(1)(c) GDPR (legal obligations, in particular AMFG, BAO, UGB)
• Art. 6(1)(f) GDPR (legitimate interest in continuous improvement and impact evaluation)
• Art. 6(1)(a) GDPR (consent, e.g. for image and sound data)
Data disclosure within the scope of MTOP Connect:
If you participate in the placement process via MTOP Connect, your profile information (qualifications, professional experience, goals) will be shared with potential employers. This is done exclusively on the basis of your explicit consent.
3.3 Corporate Partners (MTOP Connect and MTOP Diversity Expert)
As part of our cooperation with companies, we process the following data of the respective contact persons:
• Master and contact data: name, position, company, e-mail, telephone number
• Company data: business data, job profiles, requirements
• Communication and contract data

4. Newsletter
If you subscribe to our newsletter, we process your name and e-mail address for the purpose of regularly informing you about developments at MTOP and relevant topics relating to the labour market, diversity and inclusion.
Our newsletter is sent via MailerLite (UAB "MailerLite", J. Basanavičiaus 15, Vilnius, LT-03108, Lithuania). MailerLite processes your data as a data processor on the basis of a data processing agreement. Further information: www.mailerlite.com/legal/privacy-policy
You can unsubscribe from the newsletter at any time via the unsubscribe link at the bottom of each newsletter e-mail or by sending an e-mail to kontakt@mtop.at.
Legal basis: Art. 6(1)(a) GDPR (consent). Withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal.
5. IT Tools Used and Data Processors
In the course of our activities, we use the following IT tools whose providers may process personal data as data processors:
• Google Workspace (Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland): e-mail, calendar, document management
• Slack (Slack Technologies, LLC, 500 Howard Street, San Francisco, CA 94105, USA): internal team communication and communication with Associates
• SmartSuite (SmartSuite Inc., USA): project management and CRM
• YAMM / Yet Another Mail Merge (Romain Vialard, France): e-mail campaigns via Google Workspace
• MailerLite (UAB "MailerLite", Lithuania): newsletter delivery
• Wix.com (Wix.com Ltd., Israel): website operation
All data processors are contractually obligated to treat your data confidentially and to process it exclusively within the scope of service provision. Where data is transferred to third countries outside the EU, this is done on the basis of standard contractual clauses of the European Commission or an adequacy decision (in the case of the USA: EU-US Data Privacy Framework).
6. Transfer to Third Countries
Some of the tools we use are based in third countries (in particular the USA). The transfer of personal data to these countries is carried out on the basis of standard contractual clauses pursuant to Art. 46(2)(c) GDPR or, in the case of the USA, on the basis of the EU-US Data Privacy Framework (adequacy decision of the EU Commission of 10 July 2023).
7. Retention Period
We store your personal data only for as long as is necessary for the respective processing purposes or as required by statutory retention obligations. The following statutory periods apply in particular for Austrian companies:
• 7 years for accounting-relevant documents (BAO, UGB)
• 3 years for general contractual claims (ABGB)
• For application documents: 6 months after rejection, unless consent to longer storage has been given
After expiry of the respective period, your data will be deleted or anonymised in such a way that a personal reference can no longer be established.
8. Your Rights as a Data Subject
Under the GDPR, you have the following rights with regard to your personal data:
• Right of access (Art. 15 GDPR): You may request information about the data stored about you.
• Right to rectification (Art. 16 GDPR): You may request the correction of inaccurate data.
• Right to erasure (Art. 17 GDPR): You may, under certain conditions, request the deletion of your data.
• Right to restriction of processing (Art. 18 GDPR): You may request the restriction of processing.
• Right to data portability (Art. 20 GDPR): You may receive your data in a structured, machine-readable format.
• Right to object (Art. 21 GDPR): You may object to processing based on legitimate interests.
• Right to withdraw consent: You may withdraw any consent given at any time with effect for the future.
